The following Australian Harness Racing National Rules Book Amendments, which were approved at the Harness Racing Australia AGM on 18 October 2010, have been adopted by Harness Racing NSW and are effective from Wednesday 27 October 2010: Add new Rule 75(2)(lll) (HRA approved 18 October 2010) 75. (2) (lll) where a horse is declared to race in a claiming race and is subsequently withdrawn, the trainer shall if so directed by the stewards bring the horse to the racecourse. 5. HORSES Temporary Transfer of Horse Amend Rule 119A(1), (2), (3) (HRA approved 18 October 2010) Renumber Rule 119A(2) to 119A(4) (HRA approved 18 October 2010) 119A. (1) Where a trainer intends to leave his horse with another licensed trainer or another person the trainer must obtain approval from the stewards prior to doing so. (2) The period in which a horse may be left with another licensed trainer or another person shall not exceed 6 weeks from the date of approval. (3) The details of the request must be confirmed by the trainer in writing within the time and contain the information required by the Controlling Body. (4) A trainer who fails to comply with sub-rules (1), (2) and (3) is guilty of an offence. Add new heading and new Rule 119B (HRA approved 18 October 2010) Eligibility for Nomination 119B. Unless the stewards otherwise approve, a horse shall not be eligible to be nominated for a race unless the horse has been trained by a licensed trainer for not less than 28 days immediately prior to the date fixed for nomination.

(1) Subject to sub-rules (2) and (3), if at any time after publication of a barrier draw in any race an apparent error is found in the barrier position of a horse the draw shall remain unchanged. (2) The barrier position of a horse in any race may be changed so long as it is practicable to do so. (3) If the barrier position of a horse in a race is to be changed, the Controlling Body shall determine the correct barrier position of such horse by random draw from the barrier positions available to that horse and the horse previously drawn in such position and all horses drawn outside that horse shall then move out one barrier position. 12. PROHIBITED SUBSTANCES Determination of Prohibited Substances Add new Rule 188A(2)(g)(iii) (HRA approved 18 October 2010) 188A. (2)(g) (iii) In fillies and mares that have been notified as pregnant so as to comply with Rule 103B at any concentration. Add new Rule 188A(2)(j) (HRA approved 18 October 2010) 188A. (2)(j) Theobromine at a mass concentration of 2.00 milligrams per litre in urine. Amend Rule 188A(3) (HRA approved 18 October 2010) The following are not prohibited substances: Antimicrobials (antibiotics and other anti infective agents) except Vaccines and antisera for the prevention of disease, Altrenogest when administered to fillies and mares, Orally administered Chondroitan Sulphate. 216. A person whether alone or in association with others shall not fraudulently or improperly nominate
or start a horse in a race.
19. ARTIFICIAL BREEDING
Artificial Breeding Requirements Embryo Transfer
Amend Rule 285A(11) (HRA approved 18 October 2010) 285A. (11) A mare who has not attained the age of 2 years or is not registered in Australia cannot be used as a donor for an embryo transfer procedure, Amend Rule 285A(12) (HRA approved 18 October 2010) 285A. (12) A donor mare which has been used in a breeding season for an embryo transfer procedure in respect of which there has been official notification of a 42 day positive test result to such transfer shall not be used in the same breeding season for any method of breeding. Sperm Sorting Add new heading and new Rule 286(1), (2) (HRA approved 18 October 2010) 286. (1) A foal that is the product of sperm sorting shall not be eligible for registration. (2) A person who fails to comply with sub-rule (1) is guilty of an offence. 21. GENERAL MATTERS Indemnity Against Claims Amend Rule 301 (HRA approved 18 October 2010) 301. (1) A claim at law or in equity shall not be maintainable by a person to whom these rules apply against any steward, authorised person or official in respect of any action performed by such steward, authorised person or official for the purpose of giving effect to all powers and duties under the rules. (2) Any steward, authorised person or official performing or exercising powers or duties under the rules shall stand indemnified by the respective Controlling Body against any such claim.
